Any reliance you place on such information is therefore strictly at your own risk. You need to make your own enquiries to determine if the information or products are appropriate for your intended use.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Through this website you may be able to link to other websites which are not under the control of add-a-pad.com. We have no control over the nature, content and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the website up and running smoothly. However, add-a-pad.com takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

1  Interpretation

In this agreement:

‘Caravan’ or ‘vehicle’ means the vehicle listed and identified in item 4 of the Particulars of Hire.

‘Fees and Charges’ means the fees and charges set out in item 5 of the Particulars of Hire.

‘Hirer means the person who signs this agreement personally or by an agent as listed as the Hirer in the Parties to the agreement;

‘Rental Period’ means the period beginning on the Start Date and ending on the Finish Date as set out in item 1 of the Particulars of Hire or, if the Caravan is stolen or damaged beyond repair, the date on which the insurance company confirms that it will accept that Caravan has been stolen or damaged beyond repair.

2  Rental of Caravan and extensions of Rental Period

Add A Pad Pty Ltd agrees to rent the Caravan to the Hirer for the Rental Period and the Hirer agrees to take the Caravan on hire for that period and to pay the Fees and Charges for the hire of the Caravan for that Rental Period, together with any applicable GST, on the terms and conditions set out in this agreement. The Hirer is entitled to use the Caravan for the Rental Period and for any agreed extension of the Rental Period.

Not less than 14 days from the Finish Date, the Hirer may make a written request to Add A Pad Pty Ltd to vary this agreement by extending the Rental Period for an unspecified period or until a particular date. Add A Pad Pty Ltd must within seven (7) days of receiving the Hirer’s request, notify the Hirer in writing whether or not Add A Pad Pty Ltd agrees to grant that request and the revised terms if any.  In the absence of any express acceptance of those terms, this agreement will expire on the Finish Date specified in item 1 of the Particulars of Hire.

3  Rent for Caravan and other payments

The Hirer agrees to pay to Add A Pad Pty Ltd the Fees and Charges of this agreement for the hire of the Caravan for the Rental Period, together with any applicable GST.

The Hirer also agrees to pay any duties, fees, outgoings, penalties, fines, demands, charges or costs imposed by any authority on or in connection with this agreement or the Hirer’s rental of the Caravan.

The Hirer must also on demand reimburse Add A Pad Pty Ltd for all costs, charges, expenses, fees, disbursements paid or incurred by Add A Pad Pty Ltd of or incidental to:

(a)             any breach, default or repudiation of this agreement by the Hirer (including, without limitation, the fees of any debt recovery agents or other professional consultants properly incurred by Add A Pad Pty Ltd in consequence of, or in connection with, any such breach, default or repudiation); and

(b)             the exercise or attempted exercise of any right, power, privilege, authority or remedy of Add A Pad Pty Ltd under or by virtue of this agreement, including all amounts incurred in repossessing the vehicle from the Hirer under the terms of this agreement and in enforcing this agreement generally.

The Hirer authorises Add A Pad Pty Ltd to complete any documents necessary or desirable to enable the Hirer to make any payments through any credit card system.

The Security Bond set out in item 5 of the Particulars of Hire is fully refundable provided the vehicle is returned without any damage and within the Rental Period.  Add A Pad Pty Ltd may deduct from the Security Bond all amounts payable under this agreement including, without limitation, any costs arising under clause 11.

4  Hirer’s consent to access

In consideration of these presets and the sum of one dollar ($1.00) if demanded, the Hirer consents and agrees to Add A Pad Pty Ltd and its employees, agents and contractors having access to the land situated at the location set out in item 2 of the Particulars of Hire (or, if not Add A Pad Pty Ltd of such land, will cause the relevant owner to agree and consent) for the purposes of carrying out the terms of this agreement (including, without limitation, repossession under clauses 9 and 12) and agrees not to interfere with or in any way impede Add A Pad Pty Ltd’s access to such land in carrying out its activities under this agreement and Add A Pad Pty Ltd will not be liable in respect of loss or damage arising from such entry or repossession of the vehicle.

5  Vehicle pick up and drop off

Vehicle pick-up and drop-off will be between the hours set out in the item 1 of the Particulars of Hire. Vehicles must be picked up and dropped off by Add A Pad Pty Ltd and its employees, agents and contractors only, at the location set out in Item 2 of the Particulars of Hire. After hours pick-up and drop-off may be made by prior arrangement only and may come at a further cost to the Hirer. Efforts will be made to deliver and collect the Caravan at a mutually agreeable time however the Hirer acknowledges that this may not be possible in some circumstances.

6  Representations & warranties

The Hirer acknowledges that no representation warranty condition or description either express or implied is or has been made or given by Add A Pad Pty Ltd as to the quality fitness safety or otherwise of the vehicle and that all warranties and conditions whether express or implied are excluded except such conditions and warranties as are implied into this agreement by the Trade Practices Act 1974.

The Hirer acknowledges having inspected the vehicle before signing this agreement and agrees that it is fit for purpose, clean and in good condition. The Hirer agrees to return the vehicle to Add A Pad Pty Ltd in the same condition except for normal wear and tear.

7  Hirer’s covenants regarding use of the Caravan

The Hirer agrees that he or she will:

(a)             keep the Caravan in first class condition and in good and substantial repair and only use it as they would be used by a careful and prudent owner;

(b)            not use the Caravan for any illegal purpose;

(c)             not smoke, permit use by pets, use LPG gas cylinders or grey water in the Caravan nor tamper with or remove fire safety equipment;

(d)            report any damage or loss to the Caravan to Add A Pad Pty Ltd immediately such damage or loss occurs;

(e)             not tow or move the Caravan once established and fixed by Add A Pad Pty Ltd at the drop off location set out in item 2 of the Particulars of Hire; and

(f)              only use approved 10-15 amp power cords and converters for providing power to the  Caravan;

8  Insurance

Add A Pad Pty Ltd’s insurance policy has an excess. The Hirer will be responsible for the payment of such excess in respect of any damages, howsoever caused.

9  Repossession

Add A Pad Pty Ltd may immediately retake possession of the Caravan if the Hirer breaches any provision of this agreement or it otherwise terminates this agreement pursuant to clause 12.

10  Exclusion of liability

It is an essential precondition to you using our website that you agree and accept that add-a-pad.com is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Add A Pad will not be liable to the Hirer for any loss, damage or inconvenience caused by delayed delivery of the vehicle, or by the vehicle not being as described in any advertisement, or by the vehicle not being suitable for the Hirer’s purposes. Add A Pad Pty Ltd will not be liable for any loss or inconvenience from change in drop-off location caused by natural disasters such as floods, cyclones, hailstorms, earthquakes, etc, nor for any personal injury or damage to the Hirer’s property caused thereby.

11  Indemnity

The Hirer shall indemnify and keep indemnified Add A Pad Pty Ltd from and against all claims, loss, damages and expenses whatsoever, incurred directly or indirectly by reason of any breach of the agreement, negligence, tortuous act or other wrongdoing by the Hirer and without limiting the foregoing, the Hirer shall indemnify Add A Pad Pty Ltd specifically for:

(a)             any duties, fees, outgoings, penalties, fines, demands, charges or costs imposed by any authority on or in connection with this agreement or the Hirer’s rental of the Caravan;

(b)            all damage to or loss of the Caravan howsoever arising to the extent to which the same is not recoverable under any policy or insurance;

(c)              all claims damages losses and expenses in connection with any injury to or death of any person and damage to any property howsoever arising from or incidental to the possession use or operation of the Caravan;

(d)              the cost of rectifying all tyre damage not attributable to normal wear and tear;

(e)              the costs of rectification of all undercarriage damage;

(f)              the cost of repairing all body damage unless such damage can be attributed to a specific accident on a public road;

(g)             the costs of rectification of damages to suspension, chassis, axles, wheels or other damages caused by abnormal use, misuse or abuse of the vehicle; and

(h)             the costs of replacing any missing equipment.

12    Termination

This agreement may be terminated by Add A Pad Pty Ltd at any time if, in its absolute discretion, it considers that the Hirer is a credit risk, the Hirer is in breach of the agreement or in any event on the provision of 7 days notice in writing by Add A Pad Pty Ltd to the Hirer. If termination occurs, Add A Pad Pty Ltd may immediately retake possession of the Caravan and all outstanding sums owed to Add A Pad Pty Ltd by the Hirer shall become due and payable immediately.

13  Assignment

Add A Pad Pty Ltd may assign any of its rights or obligations under the agreement to any third party at any time without notice to the Hirer. The Hirer may not assign any of its obligations under the agreement without the prior written consent of Add A Pad Pty Ltd.

14  Ownership of vehicle

The vehicle shall remain the property of Add A Pad Pty Ltd and notwithstanding any provision of this agreement the parties agree that the vehicle is not deemed to be a fixture to land by operation of the law. The Hirer agrees not to sell or otherwise part with possession of the vehicle other than in accordance with the terms of this agreement.

15   Entire agreement

This agreement is the entire agreement between Add A Pad Pty Ltd and the Hirer in respect of its subject matter and all conditions, warranties and terms implied by custom, general law or statute that are not expressly set out in the agreement are excluded to the maximum extent permitted by law.

16  Waiver

No waiver of any right under this agreement or delay in enforcement or any other indulgence shall affect the rights of a party under this agreement and all the rights and powers of that party will remain in full force and effect not withstanding any such waiver, delay or other indulgence.

17  No amendment

This agreement shall not be varied except by a document in writing signed by the parties.

18  Governing law

This agreement will be governed by the laws of Queensland, Australia.

19  Your Privacy

At add-a-pad.com, we are committed to protecting your privacy as an online visitor to our website. We use the information we collect about you to maximize the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our privacy policy below carefully.

You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure server. add-a-pad.com’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.

20  Storage and security of your information

We receive and store information you enter on our website or give us in any other way from time to time. You may provide basic contact information such as your name, phone number, address, and email address to enable us to send information or process your product order and we may also collect additional information at other times, including but not limited to, when you provide feedback, change your content or email preferences, respond to a survey, or communicate with our customer support.

We may use personal information collected from you for the purpose of providing you with direct marketing material, updates regarding our website and information in the form of a newsletter. This will only apply if you have registered or subscribed to such publications by registering your details with us. However if you wish to cease receiving any such information you may let us know either by email or unsubscribing at any time and your request will be actioned immediately.

Individual profile and company details are not used for any other purpose. Details are only supplied to a third party supplier when it is required by law, for goods or services which you have purchased or to protect our copyright, trademarks and other legal rights.

We respect the privacy of our online visitors. We may collect information on or through this website that can personally identify you. For example, we collect personally identifiable information which you volunteer to us to respond to visitor questions and comments about us and our products and services, and to mail e-newsletters (“Personal Data”).

We will use all reasonable means to protect the confidentiality of your Personal Data while in our possession or control. We will not knowingly share any of your Personal Data with any third party other than our service providers who assist us in providing the information and/or services we are providing to you. To the extent that we do share your personal information with a service provider, we would only do so if that party has agreed to comply with our privacy standards as described in this privacy policy. Some of our service providers may be overseas and may not be subject to Australian Privacy Laws. Please contact us if you require specific details.

Any non-personal information, communications and material you send to this website or to us by email, or which we obtain from third parties without promises of confidentiality, may be kept, used and disclosed by us on a non-confidential basis. We are free to use and reproduce any such information freely, and for any purpose whatsoever. Specifically, we will be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose, including developing, manufacturing or marketing products.

21  Secure credit card payment

Add-A-Pad has engaged a globally accredited payment gateway service provider (Stripe) to secure all aspects involving customer payment via credit and debit cards.

All customer card information is securely submitted and processed entirely on specialised Stripe systems; Add-A-Pad staff cannot access, view, process or store sensitive cardholder data (such as credit card numbers, PIN codes or CCV codes). Credit card details are encrypted by the customer’s browser before they are sent to Braintree systems, and are never exposed in clear-text.

Stripe is globally certified to meet the regulatory security requirements outlined by the Payment Card Industry Data Security Standard (or PCIDSS). PCIDSS certification is required by banks and credit card issuers in order to allow merchants such as Add-A-Pad to accept payments from customer credit cards.
